Court Of Appeal Gives Buhari Order Over Alleged Certificate Forgery

Published

on

The Court of Appeal Abuja division on Monday ordered President Muhammadu Buhari to respond within five days to the appeal filed against his qualification for the 2019 presidential election.

The court also ordered the All Progressives Congress, APC, and the Independent National Electoral Commission, INEC, to within five days respond to all issues raised on the educational qualification of the President in the election.

Justice Datti Yayaya who issued the order, also directed that Buhari’s Counsel, Abdullahi Abubakar, to within the period file necessary processes in relation to the appeal.

The appeal was filed by Agu Kalu, Labaran Ismail and Hassy El-Kuris.

The decision of the appellate court was sequel to a motion on notice filed by Counsel to the appellants, Uchenna Ndubuisi.

Ndubuisi prayed the Court of Appeal in the motion to abridge within which Buhari, APC and INEC will join issues with the appellants on the certifcate suit.

Abubakar and Temitayo Lasaki  Counsel for APC had urged the appellate court in their response to the motion to give them five days to enable them file their respondents’ brief of argument along with other processes so as to set the stage for hearing of the substantive appeal.

Kalu, Ismail and El-Kuris has approached the appellate court to nullify and set aside the Judgment of the Abuja division of the Federal High Court .

The Lower Court had declined to hear their suit instituted to challenge the educational qualification of President Buhari before the conduct of the 2019 General election.

The appellants in their appeal are asking the appellate court to reverse the judgment of Justice Ahmed Mohammed on the grounds that the processes filed by Buhari and used to strike out their suit were not competent.

While faulting the Judgment of the High Court, which was predicated on the grounds that the suit was statute barred, the appellants claimed that the Federal High Court erred in law and in its decison.

This they said was because they did not challenge the primary election that produced Buhari as candidate of the APC.

They therefore urged the Court of Appeal to assume jurisdiction over the suit and grant all the reliefs sought at the Federal High Court but which were refused.

Among the reliefs were a declaration that Buhari submitted false information regarding his qualification and certifcate to INEC for the purpose of contesting election into the office of the President of Nigeria and that he should be disqualified.

They also prayed for an order of court directing INEC to remove Buhari’s name as a candidate of APC .

Also, an order restraining Buhari from parading himself as a candidate in the 2019 Presidential election and also APC from recognizing Buhari as a candidate.

The Federal High Court had on May 2 declined to grant the request of the appellants on the grounds that the suit was not filed within the time allowed by law and therefore sustained the preliminary objection raised by Buhari at the hearing.

However not satisfied, the appellants are now asking the Court of Appeal to grant their reliefs because they are not challenging the primary election of APC as erroneously held by the lower court.

They said they are challenging the qualification of Buhari to stand for the Presidential election without demonstrating his educational certificates as required by law.

Trump slams Biden for commuting death sentence of 37 prisoners to life

Donald Trump

US President-elect, Donald Trump, has blasted the incumbent president Joe Biden for commuting the sentences of almost every American federal prisoner on death row, as he prepares to replace the Democrat in the White House.

Gatekeeper recalls that President Biden, in his final month in office, announced that he was converting the death sentences of 37 of the 40 inmates awaiting federal execution to life without the possibility of parole.

The inmates included nine people convicted of murdering fellow prisoners, four for murders committed during bank robberies and one who killed a prison guard.

“Joe Biden just commuted the Death Sentence on 37 of the worst killers in our country,” Trump posted on Truth Social, his social media platform.

“When you hear the acts of each, you won’t believe that he did this. Makes no sense. Relatives and friends are further devastated. They can’t believe this is happening,” Trump said.

Biden had imposed a moratorium on the federal death penalty but was under pressure to act further before leaving the White House on January 20, amid signals from Republican Trump that he would resume the practice.

Three men were excluded from the move: one of the 2013 Boston Marathon bombers, a gunman who murdered 11 Jewish worshippers in 2018 and a white supremacist who shot nine Black churchgoers dead in 2015.

Again, NNPCL reduces fuel price

The Nigerian National Petroleum Company Limited, NNPCL, has again reduced its retail price for Premium Motor Spirit, PMS, to N965 per litre.

DAILY POST’s correspondent, who went around NNPCL retail outlets in Abuja, observed that the state-owned oil firm has adjusted its pump price to N965 per litre from N1040.

NNPCL filling stations along Kubwa Expressway now dispense PMS at N965 per litre.

This represents an N75 price reduction. Earlier last week, the firm had reduced its petrol to N1,040 per litre.

Meanwhile, the latest price cut comes after Dangote Refinery, in partnership with MRS filling station, reduced its petrol to N935 from N1,060 per litre.

Accordingly, Nigerians now buy petrol at N965 and N935 per litre at NNPCL and MRS filling stations in Abuja. The differential between MRS and NNPCL now stands at N30 per litre.

It was observed that a PMS price war has broken out between Dangote Refinery and NNPCL.

Reacting to the development in a statement on Monday, the national president of the Petroleum Products Retail Outlets Owners Association of Nigeria, PETROAN, Billy Gillis-Harry, and the spokesperson of the Independent Petroleum Marketers Association of Nigeria, IPMAN, Chinedu Ukadike, were optimistic about further petrol cuts amid competition.
